-and then I woke up several days later in hospital having had my leg amputated.

This is a legal term for an injury or illness that has been caused by someone else’s negligence. In these circumstances, it may be possible to claim compensation from those responsible, but the determining factor is whether your claim will be successful in light the circumstances of your claim. The most important factor is to show it was caused due to another person’s actions, negligence, omission of action, or failure in a duty of care. 

Different Types of Personal injury claims for compensation can be caused in a range of situations including:

Road traffic accident (RTA) – if you have suffered an injury following a road traffic accident where someone else was deemed to be at fault, you will be entitled to compensation. 

Accident at work – you could be injured in an accident such as a trip or fall due to malfunctioning machinery or tools, or because of your employer’s failure to protect you in a dangerous working environment, leading to health problems and injury.  

Injury on Public Property – this type of injury results from a fall on the road, tripping on a pavement, due to the negligence of the concerned parties.

Injury on Private Property – injury resulting from an accident which occurred on private properties such as a slip, trip, or a fall in a supermarket or on private property entitles you to compensation. 

Physical abuse – compensation is a possibility whether the responsibility for the abuse lies with an individual or an organisation. 

Exposure to harmful substances at work such as asbestos. 

Animal Attacks you were hurt by someone’s pet, at a zoo or by animals causing a road accident. 

Criminal – this is a result of violence/assault provided that no part of the attack was your fault.

The standard time limit for claiming compensation for a personal injury is 3 years. 

The 3-year time limit applies either from: –

  • The date of the incident which caused your injury or illness. 
  • The date you became aware of an illness which was caused by your work (illnesses caused by exposure to asbestos for instance can take decades to develop). 
  • The date you found out the cause of your loved one’s death. 

There are, however, exceptions to the standard time limit: –

  • Children – you can claim at any point up until the child’s 21st birthday for an injury that occurred before they turned 18.
  • Those who lack mental capacity – there is no time limit
  • Accidents or illnesses abroad – time limits in foreign countries can be shorter.
  • Criminal Injury (CICA) – claims made through the CICA need to be brought within 2 years.

Defective products – in addition to the standard 3-year limit, claims involving defective products must be made within 10 years of the product going into circulation.

You can claim compensation for injuries and financial losses that you can prove were caused because of somebody else’s negligence. There is no such thing as an average personal injury claim. The consequences of the same type of injury are not the same for any two people as some of the compensation awarded will be different and tailored to your specific needs. 

There are 2 parts to a personal injury compensation settlement: –

  1. General damages – this is compensation for your injury, pain and suffering.
  2. Special damages – this is compensation for expenses you have incurred, loss of earnings and any future care needs. 

Many factors can influence how much compensation you are awarded including: –

  • The severity of your injury or damage to health both physical and mental suffering/trauma
  • Whether you contributed to your injuries in some way, for example, by not wearing a seat belt and suffering injuries in a road traffic accident
  • Expenses that you have incurred
  • Loss of earnings
  • Future medical treatment and health needs
  • Rehabilitation therapy and support
  • Household adaptations

There are several different ways to cover legal costs including: –

  1. Legal Aid, although this is now only available for children who have suffered severe neurological injury at birth or within 8 weeks of birth.
  2. Legal expenses insurance – you may have this as part of a home insurance policy or if you are a member of a Trade Union.
  3. No Win – No Fee Agreements – if it is considered the claim has a reasonable chance of success, Alsters Kelley will advise you.
  4. Trade Union help.

There are different types of injuries that you can claim for when you are a victim of a road traffic accident (either as driver or passenger), these may include: 

  1. Personal injury such as whiplash, brain injury, soft tissue injury, fractures, etc. 
  2. Mental and emotional trauma.
  3. Loss of earnings.
  4. Medical costs and expenses of healthcare. 
  5. Other costs resulting directly from the accident.
