Damage to property

We acted for the owner of an upper maisonette in a period property. The owner of the flat below removed an old wooden beam and replaced it with a modern roof support joint.

This work caused substantial damage to our client’s property, including settlement of the floors and walls, resulting in substantial cracking and other damage. Initially the opponent and their insurers denied liability and court proceedings were issued.

We instructed a structural engineer to give an opinion on the merits of the claim, assess the damage and obtain builders tenders for repair works, which were extensive and costly. Subsequently the opponent admitted liability and there were then negotiations to reach a settlement on the value of the claim, which was eventually paid out by the opponent’s insurers together with the client’s legal costs.
