Court of Protection Fee Reduction

In the days when bills are rising some Court fees have been reduced!

It has been announced that the fees for submitting an application to the Court of Protection have reduced their application fees from £400 to £385.

The Court of Protection is a Court that enables decisions or actions to be taken where someone does not have capacity to make those decisions themselves regarding their property and financial affairs or their health and welfare.  These decisions are taken in accordance with the Mental Capacity Act. 

When faced with the problem of making a decision for someone who lacks capacity an application will need to be made to the Court of Protection for someone to be appointed to formally make these decisions. 

The Court can also assist in making a number of other decisions in difficult situations.

  • Whether the action that is being taken on your behalf is appropriate and whether it is in that person’s best interest.
  • Intervene where agreement cannot be reached by using an independent mental capacity advocate.
  • Times where lots of decisions need to be made rather than one decision.
  • Deprivation of Liberty challenges.
  • Taking action against an Attorney or a Deputy and removing them from this role.
  • Any other queries with regard to Lasting Powers of Attorney in particular whether the appointment is valid.
