Applications now open for refunds of Employment Tribunal fees

In July of this year, we reported that the Supreme Court had ruled that the fee regime for taking cases to an employment tribunal was unlawful.

As a result of this case, the Government has now launched a scheme for refunding employment tribunal fees paid which is now open to all Claimants and Respondents who paid fees since their inception in 2013. This follows a short pilot scheme in which around 1000 people were individually contacted and asked to apply for a refund.

Anyone eligible for a refund can apply at: www.gov.uk/employment-tribunals/refund-tribunal-fees. As well as being refunded their original fee, successful applicants will also be paid interest of 0.5% calculated from the date of the original payment up until the refund date.
